The Department will no longer tolerate the overt and covert racial discrimination that has become widespread in this Nation's educational institutions. The law is clear: treating students differently on the basis of race to achieve nebulous goals such as diversity, racial balancing, social justice, or equity is illegal under controlling Supreme Court precedent.

And for the record, the policy does not prevent ethnic, religious, or race based clubs.

LOL. You do realize these dorms are NOT segregated. Rather members of the decidedly unrepresented groups (California school age population of aaftican americans about 9% - 3% at UCB) can opt to go to a floor where they are likely to find other AA. This clearly would prohibit university funds being expended to promote/facilitate that. Notably, you omitted the sentence before the quote above which states:
"If an educational institution treats a person of one race differently than it treats another person because of that person's race, the educational institution violates the law."
The order doesn't cover students or their right to associate. Students (which are not educational institutions or covered entities) can associate and organize however they want. That is part of the First Amendment.
What the schools cannot do is give special benefits/preferences to one student group over the other based on race or create Jim Crow-esq rules that have that effect. This is settled law.
It can't give them office space. Can't likely spend money announcing them. Etc. Etc.

The letter applies to all schools across the country receiving federal funds and not just UC. And yes, there are segregated dorms.

It can give a black students association, La Raza or similar type of organization office space, publicity, or funds as long as those are made available to all student organizations on an equal basis, without consideration of race, religion, or other similar factors.

You don't understand the letter or its legal meaning. The letter says nothing about student groups. You don't understand that the first amendment guarantees freedom of association irrespective of any Trump guidance and/or congressional law.socaltownie said:

As others have pointed out:
- The student groups themselves will be subject to anti-discrimination rules/regulations. That was already the case.
- The guidance does potentially impact other UC policies, including UC housing opportunities that are set aside for only one race/religion/etc. and holding events (e.g., special graduation ceremonies) that are for only one race/ethnic group. That is a different issue.
