Can an NIL contract be made exclusive and multi-year?

Could we sign a player like JKS to an NIL deal which has a term of multiple years during which he cannot play for another college team? Would such an NIL contract hold up in court?

Not a lawyer here but I don't think there's any way that could possibly hold up in court. The clauses you're describing are similar to ones the tech industry used to include before they were challenged and removed. Tbh it seems there's always a way out of a contract anyway, it just comes down to how much one party is able to claim in damages

The question is even if it is legal what is the incentive for JKS to sign something like that.

One way or another, IMHO, it seems likely that binding contracts will come into play as the college game evolves into full-on professionalism. Big dollar NIL funders will tire of playing in aa bidding war environment. Money craves stability.

This makes sense. One one hand you have an 18 year old with a once in a lifetime opportunity to make millions at a tender age. On the other, an established cartel interested in making millions but also maintaining control.
