Options I have thought of if AAA does not have much luck. (AAA does not really have much concern for this, since AAA is not on the hook for my medical costs.) And Nationwide seems to not want to ask for damages to the car, but they may know AAA will just tell them they are wrong.

1. Write letter to Nationwide, saying they should settle this and not hold me liable, since
2. I may go to TV consumer reporter for help. (worked last time I did this)
3. I may file complaint with California Department of Insurance
4. If those don't work, I plan to get an attorney

So far there isn't a lot of medical bills, 3 doctor visits, with one coming. Chest and foot x-rays, and miscellaneous prescriptons.

But I don't know yet, when this might heal. And whether I will require Physical Therapy....

Possible good news, from AAA liability rep.

Nationwide (driver that hit me) claims adjuster has agreed to review liability with her supervisor.

Nationwide has agreed to release witness statement, if witness gives permission. (Witness was reluctant to give statement to AAA, since he already had given one to Nationwide, and said it would be the same.)

I got AAA involved after hearing back from Nationwide, even though my AAA Homeowners does not cover MY medical.

I'll take a stab.

As you stated, homeowners insurance will not cover medical bills in this case. In fact, they will never, ever cover medical bills for you or your family if someone were to be hurt on your property. Look at what the different sections are called. They are usually called liability and guest medical. It does cover your liability should someone else be injured. In other words, your homeowners policy will cover my injuries-not yours.

Your homeowners will pay for your personal property however. Some policies limit personal property to 10% if located off the premises. Also, they will pay your whatever the value of your damages minus your deductible. You stated the damage to your bike is minimal so it may not be to your advantage to have a paid claim on your record. Your premiums could easily be jacked up when it renews next go around. If you try and shop all the other companies will run your loss history and you will have a paid claim on your record and I can say with almost 100% certainty that you will be surcharged by the new company.

It looks as if the biggest expense is medical. This is where I suggest you use your personal medical insurance. In this case, this what it is for. Your medical insurance will pay the bills-minus your deductible of course. When you first fill out your forms they usually ask how/when/where you were injured. Your medical insurance can then go after the other insurance. This process is called subrogation. Unlike homeowners or auto insurance, medical insurance will not raise your rates for filing a claim.

In the end, best case scenario is that through subrogation you get all your money back for your injuries-including your deductible. Worst case is you are out your deductible and your medical insurance picks up the rest.

Everybody should have medical insurance! I found this out the hard way when, in my 20s, I went w/o for a couple of years in between full-time jobs. Needless to say, that was when I needed to have an emergency appendectomy.

My random encounter with a car (while cycling) was one of my many good luck stories: I rolled across the hood, up, over the windshield and flew through the air, landing behind the car (riding buddy said it was "spectacular"). Worst injury was a bruised chest cavity (painful, but healed in a week), plus some other minor cuts, scrapes and bruises.

I do have medical insurance. Would not be without it. I pay about 30% of the bills, after a deductible is reached.

our unique american system fails many many people.

just one for instance i went uninsured (terminally stubborn) commando style for the last 20 years. got medicare coverage last week, thank oski, but refused on principle to subsidize mob aspiring protection rackets.
