It's seriously sad to watch your transformation. I am not saying that as an insult, but as an objective plea to just take a breath and back down a bit and check in with yourself if the views you are representing are truly your own and actually comport with your beliefs. I don't know who that dude is but it's a crazy take. $800m is a lot of money even for Fox. It represents just about all of their net income for 2020. This will obviously have repercussions on the way they run their business.

It's also a massive home run for Dominion and likely represents more total revenue than the company has had in its entire history. It reportedly took in ~$120m in 2020. So from Dominion's standpoint there was no way they could turn this money down. I'm confident that Dominion would have won at trial but believe that this settle my is likely to be higher than the amount they would have received in economic damages which is why they were forced to take the offer. Defamation cases always have these big top line demands and settle for far less. This could be the largest defamation settlement in history.

I thought it would settle for $300m or less. I think it's fair to assume there was a lot of bad stuff that Fox didn't want to get out at trial and considering how much we've already seen, hard to imagine how bad it was. I assume Dominion held back a lot in order to give Fox incentive to settle.

This was an example of bad litigation management by Fox. Once the discovery request came and they saw all of the damning texts and e-mails from their internal folks, they should have gone on hyperdrive to settle before all of that got out.

Now, the bad stuff is out, and everyone knew that there was no way they were going to let their sacred cows (from the management to their key talent) testify in court where they had no control, could not just end the interview or lie. Everyone who ever managed litigation knew it would never get to the stage where Tucker or Hannity would be called as witness and create an existential threat for Fox.

Now they pay an outrageous amount, had all that bad crap made public anyway, and paid enough that shareholder lawsuits are not far behind. And there are still more cases in the pipeline who are not going to settle for pennies on the dollar after seeing this.

Silly to argue this was a loss for Dominion. Just more idiotic takes from a twitter hero who has no practical experience on how settlements are conducted or valued, including assessing value based on probability and damages. This was a win for Dominion. Maybe not a win for those who wanted additional pound of flesh from the Tuckers of the world, but still a win for Dominion.
