Democrats Win Enough Seats Nationwide to End Electoral College | The New Republic https://newrepublic.com/post/217594/democrats-seats-nationwide-end-electoral-college

"With Democratic victories in state legislatures and governorships across the country Tuesday, the Electoral College could now be in jeopardyeven without a near-impossible constitutional amendment.

If passed by enough states, the National Popular Vote Interstate Compact would effectively nullify the Electoral College and, with it, the possibility of a candidate being elected president without winning the popular vote. Since the compact was introduced in 2006, 19 states have passed it, agreeing to assign their electoral votes to whichever candidate wins the national popular vote. That amounts to 222 of the 270 electoral votes that a candidate needs to win the presidential election."

Interesting topic.

As the Article points out there are problems. The first is whether Democratic pass the law, which could come back to haunt them. They may not want their state being forced to vote for someone their state didn't vote for, and further small states are not going to agree to this. In Nevada, it was a symbolic vote by the legislature and the fiix was in that the Democratic Governor agreed with parties to veto it. Nevada, which despite growth still is a small population state doesn't want to be ignored.

The second problem is with the Compact being unconstitutional. Besides the arguments made in the article, at least with this current SCOTUS, is the framers of the Constitution deliberately rejected a direct national popular vote for president. An interstate agreement designed to bypass or effectively nullify the intended mechanics of the Electoral College without a formal constitutional amendment fundamentally alters the constitutional structure. So you start with three votes against the Compact from the originalists on the current Court.

I will let others argue the (small) state rights versus majority rule which has been an issue since the constitution was drafted. Someone is going to say at some point why even have a Senate? But I'm all in favor of eliminating minority protections whether that be filibusters in the Senate or the Electoral College. Our votes should matter.

Let's make it happen. Let the Supreme Court declare popular vote unconstitutional. Will make it easier to reform this unpopular Supreme Court.

SCOTUS may be even more unpopular with MAGA presently.

Small states and maybe swing states will veto it because a lot of money flows into these states every four years.
