He asked for that amount. That is not even close to what he got.

We don't know and will never know what he settled for. Newspapers don't settle for nuisance value - otherwise they would see thousands of strike suits. They are willing to fight on on principle. That they settled here and were forced to say they settled, suggests they had to.

Anyone getting legal advise over twitter is a fool.

Well, you being a lawyer, I assume you appreciate the importance of confidentiality obligations and why the moron pundits who feel like they need to tweet something in breach of that obligation while representing the company will incur the wrath of the legal department.

Yes, I honored such clauses for 36 years. The inside joke is that such clauses rarely have teeth in them. No one is stupid enough to have either forfeiting the settlement or a large liquidated damages clause be the penalty for violation of the confidentiality. Therefore, you can rarely prove any damages as a result of breach of the confidentiality clause. He just doesn't want to be humiliated having the public know he settled for .01% of the damage prayer of his complaint....but I agree that an honorable person would not breach it.

I think the danger is termination of the settlement agreement and pursuit of the lawsuit. Whatever the reason was for the parties, including CNN, to settle, the legal department would not be happy with incurring legal expenses again to defend because a moron pundit wanted to show how clever he was on Twitter.

I never saw a settlement agreement where the penalty for breaching the confidentiality agreement was rescission of the settlement agreement. If an opposing counsel had demanded the inclusion of such a penalty in the settlement agreement in one of my cases, I would have said, "No settlement. Bring your trial suit to the cleaners and buy some new diapers."

You would have more experience on this than I would. However, wouldn't it depend on whether it is deemed a material breach and, if so, the agreement would be terminated for cause, right? In any case, whatever. The CNN pundit is an idiot.

Not to let facts get in the way, but some idiot at CNN acknowledged CNN paid Sandmann a few million dollars in January. He apparently was fired or is on his way out for breaking the non-disclosure. And given what he said, the aggrieved party I most likely to be CNN, not Sandmann who got millions for standing at a protest. If true, that probably is not a good precedence. However, the Post may have had to cough of some money to get out, but they were in a different situation HAVING PUBLISHED A RETRACTION soon afterwards. The result was the case against the Post was dismissed and then reinstated with less causes of action. I don't see the Post settling for anywhere near CNN money, but more than nuisance value given they actually admitted they got it wrong and retracted. Notice this is my opinion, not fact.

Sandmann's attorney, who likes to argue cases in the press (actually on twitter), contests the amount that another CNN guy said Sandmann "probably" should have received - around $25K. And what he really did is report what some other guy named Zaid "thought" that Sandmann received might be around $25K. Speculating at what someone was paid is not actionable as far as I can tell. Opinion is not actionable, incorrect facts may be actionable. But in this case, it is repeating an opinion, which really is not actionable.

Point is that the Post and Sandmann's attorney are not telling the amount because (1) they have reputations to protect, and (2) it will be very hard for them to enter into settlements in the future if they leak stuff. So guys like Zaid can speculate all they want, and have their opinions broadcast on CNN, and Sandmann or anyone else can't do a thing about it, and we don't know if Zaid's speculation is correct, and may never know.

Interesting that was the one thing you picked out of the post.

Above the Law citing internal rumors at CNN said 25 million in a furious editorial about why media companies are now forced into settlements (their view is my comments in the post are out of date, because the media is so broke it now pays off all these lawsuits, which is interesting logic). Those rumors seem absurdly high. The NY Post quoted a CNN employee as millions. and that his job was in jeopardy (there is some irony about that considering the media uses sources all the time), As did Fox, as did the Orange County Register, and many conservative outlets. Oh and twitter and even dudes on internet sites like 247 repeated it all. So it must be right. Cornel Law Professor William A. Jacobson, was quoted, said the recovery was over $1 million based on sources. The professor said most of the amount recovered was plaintiff legal fees in what was an extensive discovery process.

Be interesting to see the the CNN guys saying publicly it was $25K. Are you sure that wasn't the Post settlement they were discussing? Interestingly, ABC, NBC, CBS, MSNBC, and many major newspapers failed to even report there was a settlement with CNN. Though CNN Business News reported the settlement as news and even quoted Sandmann's attorney to their credit. The media clearly is different today, and I guess we can all thank Twitter and Clint Eastwood.

Social media and twitterheads seek to diminish the weight of the voice of experts to America's lowest common denominator. Journalism, in contrast, used to strive to elevate the stories that need to be heard, to challenge the assumptions of the status quo, and to speak truth against power. Now journalism is a megaphone to the masses, either on the right and left. As much as the Post is awful, so if the other New York paper, the Times, in this regard. Since the success of Fox News, media outlets have become mouth pieces for liberal and conservative causes and little more.
