Texas Attorney General Ken Paxton has navigated a succession of major political, financial, and personal scandals throughout his tenure.
These controversies include felony fraud indictments, a historic impeachment trial, multi-million dollar whistleblower judgments, and highly publicized personal indiscretions.
The Nate Paul Scandal & Impeachment
The most significant threat to Paxton's political career stemmed from his relationship with wealthy Austin real estate developer and campaign donor Nate Paul.
Whistleblower Revolt:
In October 2020, eight of Paxton's top senior deputies reported him to the FBI. They accused him of abusing his office, accepting bribes, and misusing state resources to protect Paul from federal scrutiny.
Bipartisan Impeachment: The whistleblower claims prompted the Texas House of Representatives to overwhelmingly vote 12133 to impeach Paxton in May 2023. This marked only the third impeachment of an official in Texas history.
Senate Acquittal: Following a highly publicized two-week trial in September 2023, the Texas Senate acquitted Paxton on all 16 articles of impeachment, immediately restoring him to office.
Federal Investigation Closure: The Justice Department took over the FBI probe into the corruption allegations. However, federal prosecutors quietly declined to bring charges against
Paxton.Whistleblower Retaliation Judgment:
Four of the fired aides sued under the Texas Whistleblower Act. A Travis County judge ruled they were wrongfully terminated and awarded them a $6.6 million judgment.
Securities Fraud Charges
Paxton was indicted on felony securities fraud charges in 2015, mere months after taking office as attorney general.
The Allegations: Prosecutors accused him of misleading investors in a tech startup called Servergy Inc. by soliciting stock investments without disclosing he was being paid by the company.
Pretrial Agreement: The legal battle dragged on for nearly nine years. In March 2024, Paxton reached a pretrial diversion agreement requiring him to complete 100 hours of community service, undergo ethics training, and pay restitution. He did not enter a plea, and the charges were formally dismissed.
Personal Controversies & Divorce
Paxton's personal conduct became heavily intertwined with his professional scandals during his impeachment proceedings.
Extramarital Affair: Impeachment articles alleged Paxton committed bribery by benefiting from Nate Paul's employment of a woman with whom Paxton was having an extramarital affair. His former chief of staff testified that Paxton confessed to the affair in 2018.
Divorce Filings: His wife, Texas State Senator Angela Paxton, filed for divorce, citing adultery and "biblical grounds" after a period of separation.
2020 Election Legal ChallengesFollowing the 2020 presidential race, Paxton emerged as an aggressive champion of efforts to overturn the election results.
Supreme Court Lawsuit: Paxton filed a sweeping lawsuit targeting the election procedures of Georgia, Pennsylvania, Michigan, and Wisconsin. The U.S. Supreme Court summarily threw the case out due to Texas's lack of standing.
State Bar Ethics Fight: The State Bar of Texas sued Paxton for professional misconduct, alleging he used false and misleading claims in his election filings. The Texas Supreme Court dismissed the disciplinary lawsuit, ruling that sanctioning the attorney general would violate the state's separation of powers.
