In Ted Agu's death, the University tried to hide the facts. The campus eventually accepted the majority of the responsibility, and paid the family $4.5 Million.

SFGate: "Teammates said in depositions and interviews with The Chronicle that, on the morning Agu died, he struggled for an extended period of time and collapsed on multiple occasions without trainers or coaches coming to his assistance.

"The accounts offered by former football players in the depositions stood in stark contrast with what UC Berkeley officials told the media and the coroner's office.

"Teammates said that they were told to run up and down a steep asphalt hill 10 times while holding a rope together and that they had never before done the workout. They testified that Agu was showing visible difficulty in completing the drill, falling to his knees several times before he collapsed into a fetal position halfway up the hill on his final lap.

"Cal officials, meanwhile, initially told the public that the workout was routine and that they came to Agu's assistance as soon as he started struggling...."

As I said at the beginning of a Knowlton's Notes thread, him being here is the fault of the person who hired him. She's the one to blame! Everything permeates from the top and the state of our Athletic Dept.is ultimately her responsibility. Sadly, she's obviously not concerned w/Wins vs. losses. Nor the # of fans in the stands for our two primary revenue producing sports.

If I were a donor to Cal sports I would be extremely frustrated with wasting hundreds of thousands of dollars on a high priced law firm like Munger conducting a pointless investigation. I know of a guy that is retired from law enforcement and he worked for UC Berkeley's HR Dept., conducting investigations regarding complaints of harassment.

Yes, if they were actually trying to investigate, someone like that would be fine.

No disrespect to the very fine lawyers who will no doubt be involved, but you don't need the keenest legal minds in the country to interview people and ask them what happened. Big law firms love doing these investigations because it's impossible for them to lose. Dan Snyder hired Gibson Dunn recently to "investigate" their sexual harassment. I've worked at firms that have done these investigations and let's just say it's a popular assignment.
With some help from the Onion:

In an abrupt change in position, Cal Chancellor Carol Christ announced in a Berkeley press conference today, that she is ending an independent investigation by an international law film into allegations against women's swim coach, Terry McKeever. These broad ranging accusations were reported in a newspaper article by reporter Scott Reid.

Christ indicated while all the accusations matter, she wanted a new type of coach for student-athletes attending Cal. She indicated that Cal was full of traditional grim, determined, and emotionally unavailable coaches, who often motivated their players through criticism, discipline and other forms of conduct that were no longer acceptable. "We need to adjust to the times," Christ indicated.

At this point, Christ introduced the new head women's swimming coach, Chloe Emma Goodwill, the mother of one of the swimmers accusing McKeever of misconduct. Goodwill promised the swimmers a new type of program with genuine humility and heartfelt remorse at past behavior. Goodwill noted: "we need to in incorporate safe spaces and trigger warnings, as well as a bias-response hotline for all player parents that reaches the very top of the Cal organization chart. After all, these parents are the ones who obsessed with getting their kids into increasingly competitive four-year colleges, refused to let their kids play outside by themselves, overscheduled them, and generally shielded them from the adversities of daily life that once forced young people to develop resilience and strength against adversity." Goodwill continued "that in the future all athletes will be treated the same, even if that means holding certain athletes back. By recruiting hundreds of high-profile athletes with natural speed, strength, and agility, Cal coaches were in a position to play favorites, at the expense of other players. That kind of behavior is now unacceptable. And competition- forget about it - every one of our dear little girls now gets a participation prize."

Christ returned to the podium to announce that coaches will no longer be allowed to raise their voices, curse, show anger or otherwise adversely the impact the culture of safety for Cal's psychologically fragile student-athletes. As such, Christ announced that Justin Wilcox and his entire coach staff had been terminated, as well as coaches Jack Clark, and Kirk Everist, and that Cal will be reevaluating the coaches of any other programs that had success in recent seasons. Christ added: "We, of course, will not examine our basketball programs, as it is clear from their records that there is no player discipline."


Christ indicated that the football program had been particularly egregious. Linemen were being bodied shamed by being told to get into shape and lose fat, suffering irreversible psychological trauma. "Any new coaches will never use the trigger words "shape" or "fat" again, that clearly are meant as microaggressions against sensitive large men," Christ announced. Moreover, "no coach will ever refer to our beloved rival across the Bay while using a word associated with a sexual act in the same sentence. That is just too much hate for our precious student-athletes to handle" said Christ. "That kind of language has no place in college football - except maybe on the field. And the locker rooms. And screamed from the stands. Coach Wilcox and his staff may have been modern coaches for explaining to players specifically why they was screaming at them, but we need to have pacificist, neutered coaches for our time. Finally, our great Cal neuroscientists, based on concepts they viewed on television, have developed a process so that the memories of football players and those in other violent sports, will be surgically divided between their sports careers and personal lives, so they will not have the relive the horror of their game experiences."

When asked if this approach might impact on the field results, Christ said that the key now is to have players returning from their athletic endeavors unrecognizably groomed and demure, in order to play important roles in the campus community where no one is exposed to intolerant and offensive ideas, such as colliding with an opponent. She indicated that Cal was now considering a new water polo coach that was known for introducing film study as a means for match preparation, teaching players the auteur theory that treats films as a reflection of the coach's vision and art, all as part of changing with the times and Cal's new values.

When asked if there would not have been value to a full investigation, Christ indicated that most serious Cal fans - those found on the website Bear Insider, - didn't want to wait for some 1,000-page report which dealt with extensive interviews and included sworn medical affidavits and other unnecessarily burdensome and time consuming activities. They wanted immediate action. She wanted to give these fans, many who are donors, what they wanted.

As for replacing Coach Wilcox, Chancellor Christ is considering selecting one particular poster on Bear Insider who claims Cal would have had a 915 winning percentage and five Rose Bowls wins in over 22 consecutive winning seasons, if only the Cal coaches would have listened to him.

Finally, Chancellor Christ indicated Coach McKeever had been demoted to the position of Vice-Chancellor of Undergraduate Studies, where she will oversee the studies of undergrad students, who Christ noted provide no real value to Berkeley, such as cutting edge research, and simply add to Campus deficits. Chancellor Christ refused to discuss the specifics of Coach McKeever's demotion, citing privacy concerns.

It hasn't even been a day since news of the allegations broke, therefore I think it is too early to say. I think it is stupid to expect former athletes to drop everything they are doing and jump on social media to defend their former coach. Most probably haven't even heard the news yet, and some very well may not be on social media (because social media is dumb).

This post certainly isnt aging very well.

If Terry did what is alleged, I can't see her surviving. I did read the article, which makes me wonder why you think what Lou did was not as bad? Did Terry bench players for not following through on her orders to slug the opposing star players? That the coach could be made the Pac 12 coordinator of officials is perverse and disturbing.

Any law firm would do for that, you don't need to pay Munger lawyers $1500 per hour for privilege.

Bozeman was still making $100k, so the accusation was that Bozeman arranged money from an LA agent, Jelani Gardner's uncle, who Bozeman had reported to the NCAA the year before for loaning Tremaine Folwkes money for a car. The Gardners set up the sting when Jelani lost his starting position and they wanted him to be able to transfer without sitting out a year. Bozeman also simultaneously faced sexual harassment charges from a young woman that had been introduced to him by….Jelani Gardner. When Bozeman agreed not to contest the charges and take Cal's settlement offer she dropped the charges. Gardner then transfered to play for Lorenzo Romar at Pepperdine.

Eh. These young ladies all come from very competitive programs and families. Swimming and lifting six hours a day is no joke. The coach sounds like a tyrant, I've heard similar stories about other coaches at various schools, picking on 2 or 3 players, usually to free up schollies from 'underperforming' student athletes.

Did Terry bench players for not following through on her orders to slug the opposing star players? That the coach could be made the Pac 12 coordinator of officials is perverse and disturbing.

Heard from several ex-players. One who used to write on BI. The AD knew. It was also not the only issue that went beyond words. People have all sorts of bad information on this thread.

Tom and Linda Gardner ought to be ashamed of themselves.
The parents pull this **** and are never held accountable.

They didnt have to accept money. They didnt have to cause a stir when Jelani became unhappy. Linda didnt have to entrap Bozeman by tape-recording a conversation over non-payment in their car at LAX. If their son wanted to play for Romar at Pepperdine, let him quietly transfer like any other student unhappy in college, sit out a year, and move on.

Remember when Gardner had the press conference while at St. John Bosco where he had 3 caps in front of him from UCLA, Arkansas, and Cal . . . and he chose Cal?

The host was none other than James Casey, a former agent standing by Gardner's side and answering some questions. Casey was the guy who paid $1800 to forward Tremaine Fowlkes for a car, which forced Folkes to serve a 14-game suspension.

James Casey, husband of Linda Gardner's first cousin.

Bozeman loaned former Cal student Suzanne Wilson $2,000 for law school.
When he found out that it was being used as part of an illegal pyramid scheme, he demanded the money back and called her repeatedly.

As part of the settlement/agreement with Wilson, she admitted in the document that she may have misinterpreted Bozeman's "effort to obtain his money as being an expression of a sexual interest in her personally. She acknowledges that this may not have been the case, and she regrets any such misunderstanding that may have resulted."

Or the fact that Knowlton referenced the "investigation" as a standard HR investigation.

For the parents, lot's of unanswered questions and frustration over an unstructured Zoom Call where there was a sense that Knowlton views this without a sense of urgency and that "there are two sides to this story".

One parent remarked that the call was without structure so as to "gauge" and "measure" the parents.
Sures sounds like more CYA from the Cal Athletic Department.

I wonder how the big donors who helped build the Legends Aquatic Complex are feeling about this.

At the very least, a six month investigation will kill recruiting. Never mind who will be training the athletes for US Nationals. Another dark cloud over a Cal athletic team that never had to happen if the adults in the room in our IAD took action in the first place. It's downright mind-boggling how utterly INCOMPETENT our IAD is.

If this had happened in the private sector, two people would have been fired and replaced by now.

If I'm a parent, I wouldnt even bother dealing with Knowlton.
I would head straight for Chancellor Christ's office.

As someone who played on a team at Cal and having talked about the McKeever situation with some other players, we find a lot of the posts here insanely naive, even when very troubled by some of the charges leveled at McKeever.

As for the don't wait until the investigation and fire everyone,, we are stunned past swimmers would not get involved publicly crowd, we offer this:

The women's soccer coach was accused by over 24 present and former players of creating toxic and abusive atmosphere in a KTVU "investigative report" in November 2020. The allegations were similar to those against Terry, over a longer period and by more players, alleging reatment of verbal and emotional abuse, body shamming, favorites vs others, risking physical harm (injured players practicing), and oh yes, something that will not doubt come out with Terry, the coach accusing players of having too close a relationship with their parents. There was a lot of turnover, and multiple women say they were ignored or brushed off by the university administration when they complained. Parents of former Cal players also reached out to KTVU to share how their kids' experiences playing soccer at the university had painful, long-term effects on their entire families. The parents and KTVU even published letters to Jim Knowlton.

Cal basically responded that the matter was under formal investigation. Sound familiar? And like Terry, McGuire had coached several star players, such as Alex Morgan, who did not discuss the matter publicly, and he is considered a successful coach, though not as successful as Terry.

As far as I can tell there is no public copy of the investigative report. McGurie was exonerated. He still coaches the soccer team. My understanding is that the investigation labelled the players malcontents who were unable to handle reasonable constructive criticism (apparently the other players stood behind McGuire). COMPLAINING PLAYERS ON THE PRESENT TEAM WERE RELEASED FROM THE TEAM. One then filed a lawsuit, which the trial Judge found had no merit and dismissed the entire law suit. The language used by the Judge on the alleged body shaming is brutal.

I have no idea (nor do any of you without some inside information) where McKeever is on the spectrum from motivational to abusive - the investigators get to figure that out.. But many of the comments made in this thread seem like utter BS in view of the soccer team investigation. What seems weird to me is that both the flare-ups on the women's teams occurred during a period when there was a portal whereby athletes can transfer to a program in which they can have a better fit with the coach. That doesn't speak to whether McKeever is the kind of coach Cal wants, but it does make you wonder why these swimmers didn't leave. It also makes you wonder why a situation where a coach McQuire) was exonerated was allowed to get so out of control.

There are some differences. Players in team sports supposedly have a much better mental health outlook than those in individual sport, which makes the soccer flare-up harder to figure. There was one poster on the pay site who discussed that swimmers have a disproportionate number of mental issues. Even the greatest swimmer in our times, Phelps, has some real demons he deals with. It is a demanding and often lonely sport. Another poster noted "the Cal swimming program is trying to recruit swimmers who are in the top 1000th of the one percent - there are 175,000 female swimmers in high schools, and the top 5 teams in college take maybe 25 total. Probably less. There are only 14 scholarships on the team. So it is not as if they are regular kids who are perhaps looking for a supportive environment - it is not division 3 or high school or even regular college swimming - these are kids who are trying to be the very best in the world right now. They are going to have by the nature of that a different experience than the kids who are going to be college swimmers who are competing for a place on the podium of a conference, for example." Let me suggest some of you take a closer look at the faux Onion article above.
