My guess is he was at-will? If that's the case he could simply walk away at any time, no notice required. And we could have fired him with no notice as well.

He was recruiting for UW while still employed at Cal. He took his list and contact information, created in the scope and course of employment at Cal, to UW and began working off that list. Cal could get a TRO against Tosh if it wanted to.

There is no question Tosh is acting badly, well beyond the "it's a business" and "I'm an at-will employee." I would never ever support having him back here, ever. I would recruit other alums to do same. You simply cannot explicitly or implicitly--by contriving some payback scenario to serve an anti-JT agenda--suggest that this behavior is ok or some adolescent reasoning that this is the new aggressive way the coaching world revolves, no, it's completely wrong.

Based on what we're learning, there's no excuse for what happened. We matched the first offer and very likely didn't know about the second one. There's no other side to this one.

I have in the past moved between competing companies. I would only do so with the explicit understanding that I would not bring trade secrets, information about new products in the pipeline, nor move customers as part of the new employment. That was a requirement before beginning any negotiations. If the new potential employer just wanted to steal proprietary information, there are cheaper options. If the new employer wanted an honorable new employee then we might reach an agreement.

That is why he's a slimeball. He earned that label recently with this departure and the way it transpired. We were most definitely not willing to "play the game" this way because that doesn't make sense. I think we're conflating many different things under the same term here.

The ultimate chicken **** thing in this is not calling Tedford and telling him face to face. That is really what puts what ultimately is a career change over the top into poor form. It is like making a sales call, your partner standing you up, and then you realize as you leave that he is in the lobby with your competitor looking over their slides and helping them tune the pitch.

Question.<br /><br />Has the 5* bonus for Lupoi been confirmed? If so, how hard would it be for other coaches to tell Tosh recruits about it.<br /><br />"You know, if your son signs with Tosh, he gets an extra $10k. Heck, I'd probably tell you guys any type of lie if it meant I get 100 Benjamins to get Junior to Seattle."<br /><br />Is that sort of incentive commonplace? I know Oregon doesn't pay coaching bonus based on stars given out by some recruiting service, and I assume Cal doesn't, either.<br /><br />Seems as if UW found another loophole, and actually took the step of hiring a de facto street agent to be on their staff. Bring us the recruits we want, and you'll get extra money like a good agent does.

if the whole Tosh thing speeds up the demise of Tedford, why would you be unhappy with him? And, the athletic department not spending money this time-more money for Tedford's buy-out and/or for the next coach? Granted, some of the anti-Tedford people had hopes that some of the assistants would be retained, but that was pie in the sky anyway...so, for the anti-Tedford folks, was this really that bad?

I really didn't ask that with implications of a "vendatta". More the opposite, that you believe absolutely that Tedford is the wrong coach, therefore the sooner the better on a change.<br />The question of "wanting winning" (to me) is obvious, why would anyone post here otherwise? The question was-isn't anything that speeds up Tedford leaving part of the greater good, or you aren't sold he should be gone?

IF Tosh was hired to sabotage Cal's class, then Tosh is in a very precarious position. His value to UW is only for this year. And that value may be questionable as there are no results yet to show - other than McCarthy which according to this board was also a very tentative at best commit.<br />If Tosh can't duplicate a class at UW next year, at his salary, he could be gone in a flash. <br />And having shown a lack of loyalty - and perhaps ethics - once, there is no reason for Sark/UW to trust him at all in the future.
