This is the new normal. We should just dispense with SCOTUS hearings in the senate. If the senate and president are from the same party, they should appoint whomever they choose. That's certainly what the Republicans have signaled they will do, so why should the Democrats continue to play Pollyanna.

And if Democrats had been in control of the senate a couple of years ago, tRump would have been impeached and then charged with high crimes and misdemeanors, tried, convicted, and hung by whatever that genitalia looking thing is his head is attached to, in the central courtyard at Leavenworth until dead.

It seems a valuable piece of info was withheld from the committee. Gee...what a surprise...It seems Judge Jackson has a relative who keeps assaulting females. (sometimes in his own family). Jackson consistently delivered a sentence which was far below what was recommended by the prosecutors....what we have here is a clear pattern of Jackson being very soft on criminals of every stripe from child molesters to rapists within her own family..Funny how this info was hidden from the Senate committee. also, isn't this the same Judge Jackson who wanted to release many prisoners at the start of the pandemic????Why...yes, it is...So...this is a 'woman" who cannot define a woman and who is very soft on violent criminals.....terrific...just what this country needs on SCOTUS..BTW, she also said she has no idea when life begins...So, if she cannot define a woman and has no idea when life begins, she will have to recuse herself on all cases involving abortion, right??right???She also refused to divulge her judicial philosophy...really?????At her age, she cannot reveal her judicial philosophy???

Judge Ketanji Brown Jackson may not be an originalist, but she sounded like one in her confirmation hearings this week. "I believe that the Constitution is fixed in its meaning," she said on Tuesday. "I believe that it's appropriate to look at the original intent, original public meaning, of the words when one is trying to assess because, again, that's a limitation on my authority to import my own policy."

Even a nominee chosen by a Democratic president and facing a Democratic Senate felt it was necessary to say that she would adhere to the original public meaning of the text. To appreciate the significance of this development requires a bit of history.

Robert Bork described himself explicitly as an "originalist" when President Reagan nominated him to the high court in 1987. Democratic senators characterized originalism as a dangerously reactionary philosophy that would "turn back the clock" on civil rights and liberties. After the Senate rejected Bork, no Republican nominee adopted the label "originalist" until Neil Gorsuch, 30 years later. Since 2017, however, Brett Kavanaugh and Amy Coney Barrett also explicitly identified as originalists.

In her testimony, Judge Jackson said that "adherence to text" requires a judge "to figure out what those words mean as they were intended by the people who wrote them. So, at this point, I'm looking at original documents. I am focusing on the original public meaning because I'm constrained to interpret the text." This is an apt description of originalist interpretation.

"But there are times," she went on, when "looking at those words [is] not enough to tell you what they actually mean. You look at them in the context of history. You look at the structure of the Constitution. You look at the circumstances that you're dealing with in comparison to what those words meant at the time that they were adopted." This describes originalist construction, if somewhat imprecisely.

Moreover, Judge Jackson expressly disclaimed "living constitutionalism," which "infuses" the document "with my own policy perspective or . . . the policy perspective of the day."

Why does this matter? First and foremost, it legitimates originalism. "The prevailing interpretive frame for interpreting the Constitution is now very clearly looking back through history," Judge Jackson testified. "That is now the way in which constitutional interpretation is done." As Ed Whelan of the Ethics and Public Policy Center observed: "When the next Republican president nominates the next conservative nominee, it's going to be very difficult for Dems to object that the nominee is an originalist."

"We are all originalists," Elena Kagan said during her 2010 confirmation hearings. Many discounted that pronouncement because she seemed to limit originalism to the "very specific rules" in the Constitution. Judge Jackson's pronouncement was less conditional; her description of originalism was more specific and sweeping. Whether or not Judge Jackson adheres to originalism on the high court, she has affirmed that it is the norm

Why haven't you looked into all of the misconduct by Trump and his family members?

Do you think the American people would have voted for Trump if they knew that he and his family defrauded charities? Defrauded students at Trump university? Defrauded banks? Defrauded people who purchased their condos? Did you know that Kushner's father blackmailed his brother and served time? Did you know about Kushner's involvement with MBS who murdered a US journalist, had him chopped up with bone saws and lied to the world about it? What do you think about Ivanka's business dealings in China during the Trump presidency? What do you think of Trump's sons saying they get "all the money they need from Russia?" What do you think about Trump reporting more than $200 million in foreign income during his presidency without disclosing the exact source?

When you are detached enough from reality to believe tRump and his disciples are the Standard Bearers for the Good, then there is no such thing as disqualifying conduct ("I could shoot someone on Fifth Avenue and not lose one vote.")

Was coming home from Whole Foods and turned on KGO. I guess Monday night is a slow night, because they were broadcasting some taped conservative talk show host named "Jimbo" taking calls from eeejits.

KGO is a liberal/progressive station when it comes to their politics and talk show hosts, but I guess even they "sell out" on a Monday night.

A caller from Las Vegas said that he cant wait for the Hunter laptop to be exposed by Grassley and Ron Johnson, and that it would undoubtedly connect Biden to Hunter with all the corruption.

He said that Trump would become Speaker of the House, appointed after the GOP takes over the House at the midterms.

And then he went all Marjorie Taylor Greene stating that Biden should then be sent to Guantanimo Bay and EXECUTED.

Even the talk show host had to interrupt this clown and take back control of the narrative.

This is the current state of the GOP.
This is "normalcy".

To be honest, I think that Judge Jackson is being judged by both sides for being a female and a person of color.

Some see "black woman" and equate that with flaming liberal but in terms of her judicial record she is actually quite moderate and to be honest I would have liked to see a more liberal judge nominated.

However, we all know that such a judge would never be confirmed with this Senate so we take what we can get.

I would say she doesn't across as an unabashed partisan the way most judges do. Not sure it really matters since the court is so anti Democratic at this point with 5 hard line conservatives plus Roberts. The court is going to be working against the people of the country for quite some time.

KGO has really fallen off a cliff, as of late. Much of their air time is farmed out to people/companies promoting questionable nutritional and financial advice, i.e. one long infomercial.. How can they even be allowed to do that?

In the evening, they are paying for "The Jim Bohannon Show". I'm okay if they want to give a sensible Bay Area conservative some time, but "Jimbo" is not Northern California and he attracts RWNJs like shxt attracts flies.

The rest of their "personalities" kind of suck, too. John Rothman is okay. I shouldn't even waste my time, but when I'm in an under-30-min car trip, I'm lazy and just like to flip on the radio.
