Presidents have broad and unilateral powers to declassify and possess documents. They do not have to answer to the librarian at the National Archives. Both Obama and Clinton know this very well.

The facts are so bad for Trump. He's being treated with kid gloves. Anyone else would get the chair.

Anyone defending him is either dumb, unserious our anti-American. Probably some combo of the above.

I have to say, other than the fact that it's terrible for our country, puts our national security at risk, will probably make us and the world less safe and is a total effing embarassment, there are going to be a lot of great stories coming out of this case. Not to mention, any future criminal cases that are coming down the pike.

Here's just one random article about the indictment.

Above is a decent summary that doesn't make Trump look good. However, you are misinterpreting his comment on Hillary. Trump wants his attorneys to make things go away like Hillary's attorneys did by deleting her emails in anticipation of a subpoena and claiming they were all personal in nature.

I've talked a lot about how idiotic the new GOP is, but we've reached a new level of stupid.

The current argument boils down to: Biden, who is actually immune to prosecution because he's currently POTUS, should have been prosecuted for the conduct which is still being investigated but Trump, who is not POTUS, is immune from prosecution for crimes that have already been investigated and for which the Smith has apparently found tons of evidence of, because he used to be POTUS.

Even the GOP led house judiciary comm is complaining that Biden, who is immune to prosecution, should be indicted.

If the GOP were slightly less dumb, they would acknowledge that Biden cannot be prosecuted because he's POTUS and that the investigation of him is a waste of government time and money. Unlike Trump, Biden hasn't said a word because he knows there is nothing there. Even if he weren't POTUS, which he is, Biden would be fine because he reportedly had a minor level of mishandling classified information (which was not discovered until he was POTUS, at which point he could do whatever he wants with classified info). Contrast that with former POTUS Trump, who is not shielded by the constitution from prosecution, and who went well beyond minor mishandling and all the way to knowingly stealing strategic defense information, sharing it with friends at his seaside resort and storing it in his bedroom, bathroom and public facing areas like the ballroom. Again, all at his seaside resorts where tens of thousands of maroons per year (and a whole lot of spies) traipse around with no security other than Trump's secret service detail which has no role in protecting documents.

So for anyone here who believes Trump, who has no shield from prosecution, cannot be prosecuted because he used to be POTUS, but that Biden, who is POTUS, should be prosecuted, please let us know. Tell us your best argument so we can laugh at you.

I mean not me, because I have all the clowns on ignore, but the rest of the non-maroons can dunk on you if you are dumb enough to hold this untenable position.

"Battle plans for an attack on another country or Defense Department documents about our capabilities are in no universe Donald J. Trump's personal documents. They are the government's documents," Barr said on "Fox News Sunday" in discussing last week's 37-count indictment.

The former president has said repeatedly that he had a right to declassify and retain any documents from his four years in the White House.

Barr, who served in the Trump administration, said there was a distinction to be made between the president's personal documents, such as notes taken at a meeting, and "very sensitive" documents "prepared by government agencies for the purpose of government action." He also said almost anyone else in the country would have returned the documents if asked.

"This particular episode of trying to retrieve those documents, the government acted responsibly," he said. "And it was Donald J. Trump who acted irresponsibly."

The former attorney general also distinguished between Trump's handling of documents and the processes that other former presidents used in handling the turnover of sensitive documents at the end of their terms, saying they had used secure and orderly procedures.

In differentiating this investigation from others that examined Trump's conduct, Barr said he had defended Trump in the past including in response to Alvin Bragg's recent indictment in New York but this case is different.

"This idea of presenting Trump as a victim here, a victim of a witch hunt, is ridiculous," Barr said.

"Yes, he's been a victim in the past. Yes, his adversaries have obsessively pursued him with phony claims. I have been at his side defending against them when he is a victim. But this is much different. He is not a victim here. He was totally wrong that he had the right to have those documents. Those documents are among the most sensitive secrets the country has."

Trump's former Attorney General Bill Barr says that Trump Could be TOAST.

"I was shocked by the degree of sensitivity of these documents and how many there were, ... and I think the counts under the Espionage Act that he willfully retained those documents are solid counts," Barr, who served under Trump, told "Fox News Sunday."

"If even half of it is true, then he's toast."
