The issues you elaborated are important in primaries where people actually care what the Democrat party stands for. On what grounds would a clerk potentially do that?
Judge Michael Luttig's concern centers on the unique constitutional procedure used to organize a new Congress every two years. Because the House of Representatives completely disbands at the end of a two-year term, there is no Speaker when a new Congress convenes on January 3. Instead, the Clerk of the House temporarily presides over the chamber until a Speaker is elected. The grounds and mechanisms a loyalist Clerk might exploit to execute this hypothetical scenario break down as follows: 1. Control Over the Official Roll Call By federal statute (2 U.S.C. 26), the Clerk is tasked with compiling the "roll of Representatives-elect" before the new Congress meets. Only those listed on this official roll are permitted to vote for the new Speaker or participate in organizing the House. * The Ground: A partisan Clerk could assert administrative or procedural authority to leave specific Democratic Representatives-elect off the roll. * The Pretext: The Clerk might cite ongoing state recounts, active election integrity lawsuits, alleged voting irregularities, or missing/delayed state certification paperwork as a reason to exclude their names. 2.
