There is still a very interesting realignment going on in American politics and I have no idea where it will land.

Democrats obviously have a very unpopular older leadership class and a base that is agitating for younger leadership. The further-left types like Mamdani and AOC get the most attention but there are more centrist types gaining traction too (Ossoff, Buttigieg). I could see one of many factions winning out in the next primary season.

Meanwhile, Republicans have only one Trump and he only barely wins anyway. The candidates that have tried to mimic Trump's approach have underperformed, and Trump himself has not proven to be a particularly effective kingmaker in competitive downballot races. No idea where they go next.

Trump appeals to disaffected blue collar Americans, Latinos, and African American men.

Trump's ideas are largely popular. That's not changing. They'll have a big deficit on the Popular/personality part of the ledger with Rs/Independents. And there's a segment of the R party that isn't MAGA; they'll see this as an opportunity to move the party in their direction

Securing the border is popular with most Americans. I'm not sure about amnesty, which is unpopular with MAGA. The Democrats can run on those two issues and if they win, pretend everything is fine when they open the border again. My guess is they'll find a Latino male candidate to convince voters of their new platform.

There is this weird online bias that would make you think that everyone (on the right and the left) hates Barack Obama now, but just about every favorability poll that comes out says he's still pretty popular. Twitter is not real life.

It has been many moons since law school so I am more than a little rusty on my Criminal Procedure but I don't know that this ever sees the inside of a courtroom. Obama would claim his immunity and in one form or another the prosecution would have to overcome that affirmative defense, which likely means some sort of pre-trial proffer of evidence. But that gets us back to some sort of documentary evidence or one of the insider's flipping.

I understand the underlying assertions. A president has immunity from criminal prosecution for official acts within his constitutional authority. Broad swaths of presidential conduct here are likely to be covered by immunity. DOJ would have to be able to conclusively prove conduct that goes beyond official acts, like, say Conspiracy. But they have to prove it. Did Obama sign a memo ordering the IC to get Trump? Short of that or one of the insiders flipping Obama is in the clear.

I would think the DOJ would also be looking for evidence created after Obama's presidency ended, anything he said or written that would suggest some kind of coverup would not be protected by immunity.
