A cautious approach to satisfy fact finding is important, but this has been going on forever. Seems like to villains and victims have all been out there and those adjudicating should be able to nail this down. This seems to be going to excessive levels time wise.

Believe it or not, there were a handful of posters earlier on in this thread that were all touting "due process" for Coach McKeever and how they agreed with Knowlton's remarks about this being a 6 month investigation. We are nearly 4 months in since the story broke. Interestingly enough, those posters have largely disappeared.

Unless a long, slow ineffective process suits both the law firm and the client. A bit of a conflict when you hire someone to investigate yourself.

If there is a final interview w the coach, one guess is that they go through all the timelines, statements, conflicts, etc., and this last go is buttoning up any minor details or conflicts.

"...although a report on the probe's findings is likely still months away, the Southern California News Group has learned.

"U.S. Center for SafeSport investigators interviewed approximately 60 current and former swimmers, parents and others familiar with the Cal program during the more than four-month long probe, according to six people familiar with the investigation.

"SafeSport has not interviewed McKeever. An interview with her is expected to be scheduled before the bulk of the report is written, a Center spokesman said."

Cal assistant vice chancellor Dan Mogulof says the campus is unaware of a document request from SafeSport.

The report is allegedly over 500 pages, and mag reach 1,000 pages.

So Safesport is doing an extensive investigation over the last 5 months, interviewing 60 witnesses, and the athletic department and it's high priced law firm are supposedly doing a parallel investigation, presumably interviewing the same 60 people, but they are unaware of the Safesport investigation?

With JK's propensity to give out completely unwarranted extensions (McKeever, Fox, Wilcox), and with the extension that Christ gave JK, is there any way to see him as anything other than a "Manchurian candidate" AD hired to basically end athletics at Cal once and for all?

Wilcox's contract was extended 6 years through 2027 at about $5 million a year. So about $25 million for the five remaining years. Thus the $19.5 million buyout is entirely consistent with that.

Wilcox may have a contractural obligation to mitigate that by seeking other employment, but unlikely anyone is going to hire him at the same level. Most likely as a DC or HC at a lower level, but that would be only about $1 million a year. Plus we have Knowlton negotiating for us. Maybe he gives Wilcox extra money because he has had to deal with shrinking crowds and all the losing?

After reading the article, it sounds like she may have grounds for her lawsuit. But I know very little about the actual cases that brought the complaints. It's interesting that she is absolutely unapologetic and I wonder if they gave her the option of doing so before firing her. She sounds like a very strong lady and that can be both good and bad. It's also interesting that Knowlton has done a nice PR backflip on this. That guys a piece of work.

It's AMERICA.
Anyone can file a lawsuit.

Pages #16, 17, and 18 are redacted because they werent a part of the investigation by MTO.
That wasnt their goal for their client. It was outside the scope of their investigation.
But they did acknowledge previous complaints.

I suspect that our Chancellor's Office and UC Counsel has seen these pages and that they will eventually come out via a lawsuit by McKeever, the swimmers, or a University investigation of the athletic department and others besides JK will be named as well as their actions, or lack thereof.

First, this will never survive as a class action and thus be hard and expensive to persecute individual cases. Second, I suspect the plaintiffs are suing individuals and don't expect those individual to roll over. You should read McKeever's defenses in the Munger Report, this is not a slam dunk. There is some chance most of the swimmers can prevail, but expect it to be very messy, and if they whined about questions from a neutral Munger attorney, just wait until their dispositions with defendant attorneys. The best thing going for the swimmers is any trial will be in Alameda County, if it gets that far. Third, is just because you may eventually win, you still have to prove damages. Swimmers that were Olympians in medal contention could have some arguments for economic damages, but for most of the swimmers, it was why didn't you just go to another school if you wanted to keep swimming competitively? Your livelihood wasn't impaired, etc. You chose to stay - how were you damaged? Long way of saying expect many of the cases to settle for fairly nominal sums.

Now that said, that doesn't mean various administrators will walk away from this unscathed, though these cases take a long time, and even then typically settle.

That may be very likely for various plaintiffs. Plaintiff attorneys generally are not so idealistic - this is their livelihood. Have to see how this plays out.

Yeah, unless there's some attorneys fees provision … plaintiffs attorneys aren't going to waste their time on cases that affirmatively cost them money, much less pay them nothing. Contrary to the prior comment by another, generally speaking, plaintiffs attorney ARE in this to make a lot of money.
