The NCAA adopted a roster limit of 15 equal to the number of scholarships. The only walkons allowed now are those who were already walkons last year. I'm not sure if we have 15 scholarship players and 3 walkons, or we have 4 walkons and an open position.
That said, I'd think that a court injunction to give the 2022 players a 5th year could be followed up with a court injunction to give them a guaranteed roster spot, even if as a walkon. It is a one-year deal in any case.
I don't get what you mean by "open position, " which of the following 15 names are you saying does not have a scholarship/locked in roster spot?

A court ordered 16th roster spot (that's really what it is, these 5th years aren't "walkon quality," they're starters) for some teams and not others seems highly unlikely, it would be a competitive advantage and courts are not in the business of tipping the scales in sports.
