Self-described January 6 political prisoner Jake Lang has officially filed a $25 million federal lawsuit against FBI Director Christopher Wray and the Department of Justice, alleging false imprisonment, constitutional violations, and an organized government cover-up surrounding the events of January 6, 2021.

Lang, who says he was imprisoned for 1,467 days without a trial, claims the FBI and DOJ knowingly deployed hundreds of undercover agents and informants into the crowd that day and then concealed that information from defendants, juries, ...

According to Lang, the forthcoming federal lawsuit will name Wray and "hundreds of undercover agents" as defendants for alleged constitutional violations, including:

Fourth Amendment: illegal search and seizure;

Fifth Amendment: denial of due process;

Eighth Amendment: cruel and unusual punishment for prolonged solitary confinement.

"They hid exculpatory evidence the kind that could have cleared us," Lang said. "They refused to disclose how many federal agents and confidential informants were embedded in that crowd. That's a violation of every constitutional protection we're supposed to have."...

Imprisoned Without Trial

Lang says he spent over four years in custody without bond or trial, despite having no prior criminal record.

"Three times I applied for bond," he recalled. "They refused me every time. I was 25 years old when I was arrested and they kept me locked up for 1,467 days, no trial, no due process. They cut off visits, denied haircuts, and left us in filth while they built their political narrative."...

If Lang's claims are substantiated in court, it could represent one of the most explosive constitutional cases in modern U.S. history one that reopens old questions about federal involvement on January 6 and the true scale of the government's role in the event that reshaped American politics.

Perhaps unsurprisingly, the new administration found more than just one "isolated incident," describing violations of the Privacy Act of 1974, which with a few exceptions bars collection of information about First Amendment-protected speech, like political signage. Most tellingly, though, DHS investigators found in a near-exact parallel to trends in pro-censorship programs that a lot of the political controversy surrounding FEMA aid grew out of the vague way in which the agency's Disaster Survivor Assistance Field Operations Guide was written.

The Field Operations Guide instructed FEMA workers to "Remove yourself from the situation if you feel threatened" when dealing with "hostile" individuals, the only problem being, as the new report notes: "The Disaster Survivor Assistance Field Operations Guide does not define the term 'hostile.'"

"The way the guide was written, FEMA employees had leeway to skip outreach to a house if its signs made them feel uncomfortable," one Washington-based First Amendment lawyer put it last week. "So it's basically the same concept of a harm or distress standard we're seeing in Europe with speech issues, where the emotional response of the observer is what matters legally, as opposed to a concrete rule."

The DHS report doesn't describe a huge number of instances, but does list examples of FEMA workers from various relief efforts taking down political information well before the incident that actually made the news. The DC-based lawyer said the mere fact that FEMA aid can be politicized should worry members of both parties enough to do something about it. "People hate the government enough as it is.
