While the fourth amendment typically protects citizen defendants (or illegal aliens with substantial ties to the U.S.) from being prosecuted with evidence obtained in violation of it, what would the remedy be here?

LEO can enter the object of an arrest warrant's home based on the arrest warrant and do not need a separate search warrant.

An Admin warrant is effectively an arrest warrant. Admin warrants generally require a final order of removal to have been issued first, so the object of the Admin warrant has received due process (exception where the person has already been convicted of an aggravated felony, in whiich the admin order is the deportation order).

This is a change in policy for ICE. Maybe it does / does not survive legal challenge. But it is not without rational legal reasoning. It is not necessarily the abject 4th Amendment violation that some would have us believe.

Columbia Heights Public Schools Superintendent Zena Stenvik said the boy had been taken by federal agents from a running car while it had been in the family's driveway Tuesday afternoon.

Stenvik had said the family has an active asylum case and has not been ordered to leave the country.

The school official alleged officers told the child to knock on the door to his home to see if other people were inside.

"Why detain a 5-year-old?" Stenvik was quoted as saying, according to the AP. "You cannot tell me that this child is going to be classified as a violent criminal."

School board chair Mary Granlund, who witnessed Liam and his dad being detained, told reporters on Thursday that she heard an adult inside the home begging agents to leave the child but they refused.
Granlund was driving to pick up her own children from school Tuesday when she heard and then saw commotion near the family's house.

"I heard one person say: 'What are you doing? Don't take the child,'" she said.

As Granlund got out of her car and walked toward the house, she heard another person yell that someone from the school district had just arrived, referring to Granlund, and could assume responsibility for Liam, she said.

"There was ample opportunity to be able to safely hand that child off to adults," Granlund said.

She said she saw Liam's mom through the window and could hear his father yell at her not to open the door, fearing ICE agents would push their way into the house. It was not immediately clear whether the mother was detained.

Their is zero information in the above article indicating that our Federal Government is literally kidnapping kids on their way home from pre-school.

They are NOT using the children as "bait".

If you look at the actual facts that you just posted, nothing like that happened. They arrested a father and no legal family member there was willing and able to take the child. Should ICE leave a 5 year old alone? Should ICE leave them with someone who lives in the neighborhood just because they work at the child's school?

Sadly, there will always be people that have their TV sets tuned to FAUX NEWS 24/7 to swallow the latest Trump Administration propaganda from the likes of Stephen Miller, Kristi Noem, and others.

If one is actually an educated student of history, you would have found Stephen Miller's speech that he delivered at the memorial for Charlie Kirk, eerily similar to the "Storm is Coming" speech by Nazi Joseph Goebbels in 1932.

I appreciate that, unlike Diablowags, you posted something factual, which is that the family CLAIMS they are here legally. However, you then write that they took the preschooler out of school, which appears to have zero evidence supporting it. Please stop being DUPED by outrageous media sources.

I POSTED THIS FACT in my second post this morning in this thread when I quoted the public school superintendent Zena Stenvik. The family had an active asylum case and had not been ordered to leave the country according to Stenvik.

But I would not be surprised if people that I have on ignore (but who continue to reply to my posts) continue to suffer from poor reading comprehension and do nothing more than accept what Faux News has reported given their undying love for Donald Trump and his policies.

As you point out, the propaganda out of the current Administration is pretty thick.
Again, it's noteworthy that they went directly to Fox News Digital with their version of what happened here.

As a Cal alum having attended a University with a strong reputation when it comes to questioning Govt "activities" . . . I wholeheartedly agree that nothing the government says about these matters should be taken at face value.

But I guess that there will always be people that blame the protestors in the streets who are fighting for their Civil Rights.
