Both deaths shouldn't have happened. Both were caused by actions of the individual. You can't have one be okay and the other not okay.

There is other context, like the officers escalating the situation by trying to force her out of the car and one of them wrongly placing himself in front of the vehicle. But yes, in a vacuum if an officer thinks he will be run over then force may be justified.

You're right, I should have said eye witness not witnesses. There's the video of the woman talking after the event, I think it's been posted here already. She says it was clear the woman was trying to impede ICE by blocking the road

What about the context that she was disobeying legal orders to get out of her car?
I'm not claiming everything was done well by the officers. Could this have been prevented, yes. Should it have been presented, yes. My only argument this whole time has been that the shooting was lawful. Tragic and terrible, but lawful

Battery requires contact.
Assault requires a threat and an apparent intention to carry it out in a manner that causes fear or apprehension.
It is a federal crime to “assault” a federal law enforcement officer.
No contact is required.…

1. DOJ files in federal court under federal statute using Minneapolis based federal grand jury. ICE Agent could hire counsel or have counsel appointed.
