It is not clear that due process was violated here. We are lacking facts. It is entirely possible ICE initiated lawful contact with the wrong person and subsequently determined that person was also subject to detention/deportation. And it is possible the wrong person was improperly detained. The latest reporting I have seen says this person is at a detention center. That is consistent with both scenarios (ie being held while the clock ticks on his Due Process notification window or sitting in a cell improperly). But the mere fact that this person is detained does not mean civil rights were necessarily violated.
