The SCOTUS is basing its rulings on this legal principle (other than Alito and Thomas, naturally).

The SCOTUS ruling that Garcia's return from El Salvador must be facilitated renders moot, at this point, any discussion of whether he is a gang member. He certainly was never given the Due Process right to confront the CI that gave a declaration on the issue.

Garcia will end up getting deported but it must be done legally and he can't be deported to El Salvador.

Without due process, how can anyone be determined a citizen or not?

Being deported is one thing. There may be a decent case for that. Directly to prison is something else entirely. If El Salvador's government does that then that might be wrong but it's up to them. That's not what happened. Our government did that. We pay for the prison. And there was no good reason to send these people there.

Sheesh! No tattoo is going to look as crisp and precise as the MS13 on his fingers. They don't even match up well with other tattoos and are perpendicular to the photo while his hand is a few degrees off being perpendicular. It's clearly photoshopped.

It's clear that this administration has no integrity and will stoop to any level to try and ram home their wishes whether they are lawful or not. I foresee endless examples of "incriminating" photos and documents suddenly being discovered to bolster the goals of the Trump administration.
